OPINION POLICY
§1 Important information
- In the Opinion Policy you will find the rules for publishing and verifying Opinions by Małgorzata Ługowska, running a business under the name Lilly and Swan Małgorzata Ługowska, NIP: 5222713772, REGON: 360232941, address: ul. Startowa 2, 02-248 Warszawa (hereinafter referred to as the Website Owner). Fast and direct communication is possible by e-mail to the following address: hello@lillyandswan.pl, which is also a contact point for direct communication with the authorities of the Member States, the Commission, the Digital Services Council, as well as with Users using the Website.
- The opinions shared concern cooperation with us, including our Customers' experiences related to the purchase or use of our products and services (hereinafter referred to as Products).
- The purpose of the Opinion Policy is to provide you with reliable information regarding the principles of publishing and verifying Opinions, which may help you make informed purchasing decisions.
- We publish opinions of people who have purchased or used our products and services (hereinafter referred to as "Customers"), i.e.:
1) people who purchased the product,
2) persons who have concluded a contract for the provision of services or other civil law contract,
3) people who used the Product or service of the Website Owner, paid or free of charge.
§2 Principles of opinion verification
- Review verification (hereinafter also referred to as User-Generated Content) is a key element in building trust and credibility for us.
- Verification of the Opinion consists in checking whether the person giving the opinion has purchased or used our products and services and whether the Opinion does not violate the law and decency and is consistent with the Opinion Policy and the terms of User-Generated Content Moderation in accordance with the Website Regulations.
- If §3 of the Opinion Policy states that Opinions are verified, the Opinion is verified according to the principles set out below.
- Verification of Opinions by the Website Owner takes place, among others, through:
1) comparison of personal data with data and information held regarding Customers or people who have previously used the Products and services of the Website Owner,
2) comparison of the details of cooperation with available data and information regarding Customers or people who have previously used the Products and services of the Website Owner,
3) direct contact with the person giving the opinion after submitting the Opinion (e.g. with thanks for the Opinion),
4) direct contact with the person giving the opinion with a request to leave an opinion,
5) obtaining the Customer's opinion as part of direct communication with the Customer (e.g. as part of e-mail correspondence conducted in connection with cooperation),
6) sending customers a dedicated link to leave a review. - If the Opinion is published independently by:
1) Website Owner, verification of the Opinion by the Website Owner takes place before its publication,
2) the person giving the opinion, the verification of the Opinion by the Website Owner takes place immediately after its publication by the person giving the opinion. - If the Opinion is inconsistent with the principles of the Opinion Policy or raises doubts as to whether the Opinion comes from the Customer, the Opinion is not published by the Website Owner and if it was published independently by the person giving the opinion, it is immediately deleted by the Website Owner.
- The Opinion may not be published, and the published Opinion may be blocked and become invisible to other Users or be removed from the Website or its visibility may be limited in any other way if the Opinion is contrary to the law, decency, or when it is considered for unacceptable Content within the meaning of the Digital Services Act, including when:
1) has a terrorist character;
2) is contrary to the law and good practices;
3) is SPAM or repeatedly appears on the Website without a legitimate purpose;
4) is offensive, contains content with terms considered as hate speech, threats, and when it contains content inciting or supporting violence, content indicating harassment, racist, discriminatory or slanderous content;
5) violates or limits the rights of third parties, in particular the right to privacy, the right to image, the right to personal data protection, trademarks or copyrights;
6) serves to conduct competitive activities or constitute an act of unfair competition;
7) is used to conduct unauthorized advertising, promotional and marketing activities;
8) is used to conduct activities prohibited by law, e.g. financial fraud;
9) promotes a fascist or other totalitarian state system;
10) defames or insults any person;
11) violates the personal rights of any person;
12) contains vulgar language or other offensive content;
13) offends religious feelings; 14) is untrue in terms of the described facts and actual state or when it refers to products/services that are no longer included in the Website Owner's Offer. - If the actions referred to above are taken, the Website Owner will immediately notify the User who provided the User-Generated Content, providing a justification for his decision and the User may submit an appeal under the terms described in §4 of the Opinion Policy. The Website Owner is responsible for verifying the validity of the actions taken in relation to the User-Generated Content.
- The Website Owner is not responsible for User-Generated Content posted on the Website, provided that the Website Owner:
a) has no actual knowledge of illegal activities or illegal User-Generated Content and with respect to claims for damages - does not know of facts or circumstances that clearly indicate illegal activities or illegal User-Generated Content or
b) takes promptly appropriate action to remove or disable access to illegal User-Generated Content or otherwise limit its visibility or monetization upon becoming aware of or receiving such information. - The Website Owner is obliged to notify the appropriate law enforcement services/agencies if the User may have committed, is committing or may commit a crime that threatens the life or safety of a person/people and to provide all information available to him/her on this subject.
§3 Rules for publishing opinions
- Opinions on the website
1) Opinions published on the Website Owner's website are verified by him in accordance with the principles of Opinion verification described in §2 of the Opinion Policy.
2) The published opinions are intended to present the benefits related to the use of the Website Owner's products and services, which benefits have been noticed by existing customers.
3) Opinions are published independently by the Website Owner.
4) The Website Owner may use Sponsored Opinions. In such a case, the following note will be added to the opinion: 'Sponsored opinion'. - Opinions on Instagram
1) Opinions published on the Website Owner's Instagram are verified by him in accordance with the Opinion verification rules described in §2 of the Opinion Policy.
2) The published opinions are intended to present the benefits related to the use of the Website Owner's products and services, which benefits have been noticed by existing customers.
3) Opinions are published independently by the Website Owner.
4) The Website Owner may use Sponsored Opinions. In such a case, the following note will be added to the opinion: 'Sponsored opinion'. - Opinions on Facebook
1) In the case of opinions published on the fanpage independently by the Website Owner in order to present the benefits related to the use of the Website Owner's products and services, these opinions are verified by the Owner in accordance with the principles described in §3.
2) Additionally, the Website Owner enables Users of the Facebook platform to add Opinions using the 'OPINIONS'/'REVIEWS' functionality available on the platform. In this case, all opinions - both positive and negative -are published.
3) Due to the fact that the rules for publishing opinions using the 'OPINIONS'/'REVIEWS' functionality are regulated in the Community Standards of the Facebook platform [LINK] and the Website Owner has no influence on them, Opinions published independently by Users on the Facebook platform are not verified by the Website Owner. Regardless, if these opinions violate the Facebook Community Standards, the Website Owner will take steps to report the violation in accordance with the procedure provided within the Platform.
4) The Website Owner may use Sponsored Opinions. In such a case, the following note will be added to the opinion: 'Sponsored opinion'. - Opinions on Google Maps Business Profile
1) The Website Owner allows you to add Opinions using the functionality of adding opinions available on Google Maps.
2) All opinions, both positive and negative, are published on Google Maps Business Profile.
3) Due to the fact that the rules for publishing opinions by Google Maps Users within Google Maps Business Profile are regulated in the Google User-Generated Content Policy [LINK] and the Website Owner has no influence on them - Opinions published independently by Users within Google Maps Business Profile are not verified by the Website Owner. Regardless, if these opinions violate the principles set out in the Google Policy, the Website Owner will take steps to report the violation in accordance with the procedure provided for within the Platform.
4) The Website Owner may use Sponsored Opinions. In such a case, the following note will be added to the opinion: 'Sponsored opinion'.
§4 Reporting unacceptable Content and appealing against the Website Owner's decision
- Anyone may report to the Website Owner User-Generated Content that the person considers to be illegal content within the meaning of the Digital Services Act (DSA).
- The report may be submitted by e-mail to hello@lillyandswan.pl using the form available as Annex No. 4 to the Terms and Conditions on the website www.lillyandswan.pl entitled 'User-Generated content infringement report'.
- The notification referred to in section 1 should contain:
1) a reasonable explanation of the reasons why a given person or entity alleges that the User-Generated Content is inconsistent with the Regulations;
2) an indication of the precise electronic location of the information, such as the exact URL and additional information that identifies the User-Generated Content, as appropriate to the type of User-Generated Content and the specific type of hosting service;
3) name and surname or name and e-mail address of the person or entity making the report, with the exception of reports regarding information considered to be related to one of the crimes referred to in Art. 3-7 of Directive 2011/93/EU;
4) a statement confirming the good faith belief of the reporting person or entity that the information and allegations contained therein are accurate and complete. - Appeal against the decision of the Website Owner in the event that the Website Owner did not block or remove the User-Generated Content or did not limit visibility despite notification from another User or a third party, or when he did not make the above decisions despite the grounds for doing so, or when he took other actions referred to in Opinion Policy may be reported by the User who provided the User-Generated Content or the person who reported the User-Generated Content. The appeal can be submitted by e-mail to: hello@lillyandswan.pl; The appeal should contain the necessary information enabling it to be considered, including: identification and contact details of the appealing User and detailed justification indicating irregularities in the decision of the Website Owner.
- The Website Owner immediately confirms receipt of the notification/appeal electronically to the indicated e-mail address (if possible).
- The report and appeal are considered immediately, i.e. within 14 days from the date of submission, unless due to the type of illegal Content covered by the report and the urgency of the actions, verification should take place earlier (e.g. when the Content involves a threat to life or safety of people).
- The appeal will be considered by the Website Owner / under the supervision of the Website Owner's staff.

The opinion policy is subject to copyright. Copying and distributing the Privacy Policy without the consent of the Website Owner is prohibited and may be subject to both criminal and civil liability.
